One of the most frequently asked questions that our HR team receives is: Can we require our employees to wear masks? While ADA requirements may complicate things for those with employees facing medical conditions that preclude them from wearing masks, employers are obligated to maintain a reasonably safe workplace for all employees. Many companies are successfully pivoting to offer new services, including background screeners who have extended into testing employees for COVID-19. Guidance from the Equal Employment Opportunity Commission (EEOC) allows organizations to conduct viral tests because they’re permissible under the Americans with Disabilities Act (ADA). However, requiring an antibody test—which identifies those who have previously been infected with the virus—before allowing employees entry to the workplace would violate the ADA, according to the EEOC, because antibody tests constitute a medical examination under the ADA. Delta is working with Occupational Medicine Clinics as well as some Walgreens who are now offering these services as well.

Furthermore, if your work still requires you or your employees to travel across state lines, make sure you are aware of the state quarantine mandates that are complicating business travel. Developments are unfolding daily, so keep constant tabs on what lawmakers are enforcing, such as quarantining before in-person meetings during your trip, otherwise you may face a hefty fine.
